Terms & Conditions

1. Scope

These Terms & Conditions apply to private charters, experiences, upgrades and related services booked directly with Good Mood, including bookings made through our website and booking technology provider Bókun. Where a booking is made through a third-party marketplace or travel platform, additional or different terms imposed by that platform may apply to the booking.

2. Booking and confirmation

A booking is subject to availability. The applicable experience, date, departure time, guest number, price and selected extras are shown during the booking process. A booking becomes confirmed when the required booking process has been completed and a booking confirmation has been issued by Good Mood or its authorised booking provider. The payment amount and timing applicable to the booking will be shown before the booking is confirmed. The person making the booking confirms that they are authorised to make the booking on behalf of all guests included in the reservation and accepts responsibility for communicating relevant booking and safety information to them.

3. Prices and payment

Prices are generally displayed in US dollars unless another currency is expressly stated. The total amount payable for the charter and selected extras will be shown before booking confirmation. Any applicable taxes, mandatory charges or additional costs must be disclosed before the booking is completed. Optional upgrades are charged only when selected or separately agreed. Online reservations and payments may be processed using Bókun and relevant payment service providers.

4. Private charter and guest numbers

Good Mood charters are private unless expressly stated otherwise. The maximum number of guests depends on the selected Experience. The guest number stated in the booking confirmation may not be exceeded without prior written approval from Good Mood. Different capacity limits may apply to specific activities, including diving, overnight stays and private-chef experiences.

5. Experience details

Descriptions, routes, timings and inclusions are intended to provide an accurate description of the booked Experience. Because Good Mood operates on the water, routes, stops, activities and timing may need to be adapted to weather, sea conditions, safety considerations or operational circumstances. Sunset departure and return times may vary seasonally. Reasonable changes that do not materially reduce the overall Experience do not by themselves create a right to cancel or receive a refund.

6. Captain’s authority and safety

The captain has final authority concerning safe navigation; weather and sea conditions; route selection; operational decisions; swimming, snorkelling and diving conditions; and whether an activity can safely proceed. Guests must follow reasonable safety instructions from the captain and crew at all times. The captain may alter a route, activity or destination where reasonably necessary for safety. In strong wind or unsuitable sea conditions, a charter may remain within sheltered waters rather than follow the originally anticipated route. Short rain showers, cloud cover or wind do not automatically mean that a charter will be cancelled when the captain considers conditions safe.

7. Guest conduct

Guests must behave responsibly and must not endanger themselves, other guests, the crew, the yacht or third parties. Good Mood may refuse participation in an activity, or where reasonably necessary terminate a guest’s participation, if behaviour, intoxication or failure to follow safety instructions creates a material safety risk. Where a service cannot reasonably be provided or continued solely because of serious unsafe behaviour by a guest, no refund is due for the unused part of the Experience, to the extent permitted by applicable law. Guests may not bring their own alcoholic beverages onboard unless Good Mood has expressly agreed otherwise.

8. Children

Children are welcome on Experiences where the relevant product description permits them. Children without an appropriate swimming certificate must wear a suitable life jacket when required. Suitable life jackets are available onboard. Parents and guardians remain responsible for supervising children and ensuring that they follow crew instructions.

9. Swimming, snorkelling and diving

Participation in swimming, snorkelling and diving is voluntary and subject to prevailing conditions and the captain’s decision. Guests must inform Good Mood before departure of any circumstance relevant to their safe participation in an activity. The standard Private Dive Experience is intended for certified divers unless an introductory dive or private PADI course has been expressly arranged. Applicable certification, supervision and diver-capacity requirements must be followed. Alcohol intended to be served as part of a Dive Experience is served after diving only.

10. Mobility and health

A yacht environment may include steps, moving surfaces, boarding movements and wet or uneven areas. Guests with reduced mobility, relevant medical conditions, pregnancy-related concerns or other circumstances that could affect safe participation should contact Good Mood before booking or as soon as reasonably possible. Good Mood will provide reasonable practical information but cannot make individual medical assessments. Guests remain responsible for determining whether participation is suitable for them and should seek appropriate professional advice where necessary.

11. Seasickness and personal comfort

Sea movement is inherent in boating and seasickness may occur. Open-sea Experiences, including Klein Curaçao, may involve more movement than sheltered coastal charters. Normal sea movement or seasickness does not by itself create a right to a refund where the Experience proceeds safely as booked.

12. Personal belongings

Guests remain responsible for their own personal belongings onboard and during stops ashore or in the water. Good Mood is not responsible for loss or damage resulting solely from a guest’s failure to take reasonable care of their belongings. Nothing in this clause excludes liability where Good Mood is legally responsible for loss or damage.

13. Optional upgrades and third-party services

Certain extras may involve third-party service providers, including transfers, photographers, PADI professionals, chefs or other specialist providers. Availability of an upgrade may be subject to confirmation. Where a third-party service cannot be supplied, Good Mood may offer an appropriate alternative or refund the amount paid for that unavailable service. Nothing in these Terms excludes rights or remedies that the guest has under mandatory applicable law.

14. Refund Protect

Refund Protect may be offered during the booking process. Refund Protect is an optional service provided under the separate terms and conditions of the relevant external provider. Claims, eligibility and coverage under Refund Protect are determined under that provider’s terms and are separate from Good Mood’s standard Cancellation Policy.


15. Changes requested by the guest

Requests to change a booking date, guest number, Experience or selected upgrades are subject to availability and Good Mood’s written confirmation. A requested change is not effective until confirmed. Price differences and unavoidable third-party costs may apply to an agreed change. Unless Good Mood expressly agrees otherwise in writing, changing a booking does not create a more favourable cancellation entitlement than the entitlement applicable to the original booking. If a requested change cannot be agreed, the original booking remains in force and the normal Cancellation Policy continues to apply.

16. Cancellation by the guest

Guest cancellations are governed by the separate Good Mood Curaçao Cancellation Policy, which forms part of these Terms & Conditions. The standard direct-booking cancellation schedule is: More than 14 days before departure: free cancellation. 7 to 14 days before departure: 50% cancellation charge. Less than 7 days before departure: 100% cancellation charge. The separate Cancellation Policy explains how the timing is calculated, weather cancellations, no-shows, rescheduling and Refund Protect.

17. No-show and missed departure

Guests are responsible for arriving at the agreed meeting point in sufficient time for departure. If a guest or group fails to attend and the Experience cannot reasonably proceed because they have missed the departure, this will normally be treated as a cancellation less than 7 days before departure and the 100% cancellation charge applies. Good Mood will make reasonable efforts to assist with minor delays where this can be done without compromising safety, operations or other commitments.

18. Weather and cancellation by Good Mood

The captain makes the final decision regarding safe navigation and weather conditions. Where conditions require it, Good Mood may adapt the route or activities rather than cancel the Experience. If conditions prevent the booked Experience from proceeding safely, Good Mood will first seek to offer a reasonable alternative date. If rescheduling is not reasonably possible following a cancellation by Good Mood for weather or safety reasons, the guest will receive a full refund of the amount paid for the affected Experience. The same principle applies where Good Mood itself must cancel because the Experience cannot be provided for a technical or operational reason.

19. Events beyond reasonable control

Good Mood is not responsible for a failure or delay caused by circumstances beyond its reasonable control, except to the extent applicable law requires otherwise. Such circumstances may include extreme weather, official restrictions, closure of navigable areas, emergency situations or other events that could not reasonably have been avoided. Good Mood will take reasonable steps to minimise the effect on the guest and, where the charter cannot be provided, will apply the relevant rescheduling or refund provisions in these Terms and the Cancellation Policy.

20. Liability

Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law. Good Mood remains responsible for the proper performance of its contractual obligations in accordance with applicable law. Guests are responsible for loss or damage caused by their intentional conduct, negligence or failure to follow reasonable safety instructions, to the extent permitted by law. Good Mood does not seek through these Terms to exclude liability for personal injury, property damage or other loss where Good Mood is legally responsible.

21. Complaints

If something is not as expected, guests are encouraged to inform the captain or crew during the Experience where reasonably possible so that Good Mood has an opportunity to address the matter. After the Experience, complaints may be submitted to: info@goodmoodcuracao.com. Please include the booking reference and sufficient details for the matter to be investigated. Good Mood will endeavour to respond within a reasonable period.

22. Privacy

Personal data is handled in accordance with the Good Mood Curaçao Privacy & Cookie Policy. Booking information may be shared with booking, payment and service providers where reasonably necessary to process the booking and provide the booked services.

23. Applicable law and disputes

These Terms and bookings made directly with Good Mood are governed by the laws of Curaçao, subject always to mandatory consumer rights or other mandatory laws that cannot lawfully be excluded. Parties should first attempt to resolve any complaint or dispute directly and reasonably. If a dispute cannot be resolved, it may be submitted to the court that is competent under applicable law. Nothing in these Terms removes a consumer’s right to rely on any mandatory jurisdiction or consumer-protection rule that applies to them.

24. Distance bookings and cancellation rights

Good Mood Experiences are leisure services reserved for a specific date or period. Where Curaçao law applies, statutory cooling-off provisions for ordinary distance contracts may not apply to leisure services that the provider agrees to perform on a particular date or during a particular period. This does not affect any mandatory consumer right that cannot lawfully be excluded or the contractual cancellation rights Good Mood provides under its Cancellation Policy.

25. Availability of these Terms

These Terms must be made available before the booking is completed in a form that the guest can access and retain for later reference. The version applicable to a booking is the version made available when that booking is concluded, unless a later change is expressly agreed.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible. An invalid provision will be interpreted or replaced only to the extent necessary to reflect its lawful purpose.
