This Cancellation Policy applies to direct bookings with Good Mood Curacao BV, trading as Good Mood Curaçao and Good Mood. This Policy forms part of the Good Mood Curaçao Terms & Conditions.
1. Standard guest cancellation policy
For direct bookings, the following cancellation charges apply:
More than 14 days before departure — Free cancellation. The guest is entitled to a refund of the amount paid for the cancelled booking, subject only to any separate third-party service that is expressly governed by different terms disclosed before purchase.
7 to 14 days before departure — 50% cancellation charge. Good Mood will refund 50% of the applicable cancelled booking amount.
Less than 7 days before departure — 100% cancellation charge. No refund is due under the standard Good Mood cancellation policy.
2. How the deadline is calculated
Cancellation periods are calculated backwards from the scheduled local departure time of the Experience in Curaçao. For clarity: exactly 14 days before departure falls within the 7–14 day period and therefore carries a 50% cancellation charge; exactly 7 days before departure falls within the 7–14 day period and therefore carries a 50% cancellation charge; once there is less than 7 days remaining, the 100% cancellation charge applies.
3. How to cancel
A cancellation request should be submitted through the available booking-management route or by contacting Good Mood at info@goodmoodcuracao.com. Please include the booking name, booking reference, Experience and scheduled date. A cancellation is effective when it is received through an authorised booking or contact channel.
4. No-show or missed departure
A guest or group that does not attend the booked Experience and misses the departure is treated as having cancelled less than 7 days before departure. The 100% cancellation charge therefore applies. Good Mood will make reasonable efforts to accommodate minor delays where operationally and safely possible, but the yacht cannot be required to delay departure where doing so would materially affect safety or operations.
5. Guest-requested date changes
Requests to change the date of a booking are subject to availability and require confirmation from Good Mood. Good Mood will try to accommodate reasonable change requests where possible. A booking is not changed until the new date has been confirmed. Any price difference or unavoidable cost relating to an agreed change may be payable. Unless Good Mood expressly agrees otherwise in writing, rescheduling does not reset or improve the cancellation entitlement that applied to the original booking. If a requested change cannot be agreed, the original booking and its cancellation terms remain in force.
6. Weather and sea conditions
The captain makes the final decision regarding safe navigation, weather and sea conditions. A change in route or activity does not automatically constitute a cancellation. Where conditions permit the charter to proceed safely, the captain may adapt the route, destination or activities. For example, in stronger wind the charter may remain in sheltered waters. Short rain showers, cloud cover or wind alone do not automatically entitle the guest to cancel or receive a refund when the captain determines that the Experience can proceed safely.
7. Cancellation by Good Mood for weather or safety
If the captain determines that the Experience cannot proceed safely, Good Mood will first seek to offer a reasonable alternative date. If rescheduling is not reasonably possible, the guest will receive a full refund of the amount paid for the affected Experience. The captain’s safety decision takes precedence over the planned itinerary.
8. Technical or operational cancellation by Good Mood
If Good Mood must cancel an Experience because it cannot reasonably provide the booked service for a technical or operational reason, Good Mood will seek to offer an appropriate alternative or rescheduled date. If the booking cannot reasonably be rescheduled, the amount paid for the affected Experience will be refunded.
9. Route and itinerary changes
Routes and stops are always subject to safe operating conditions. The captain may reasonably alter route, destination, swimming or snorkelling locations, open-sea activity, departure or return timing, and planned activities. Where the charter can still be provided safely and the change does not materially deprive the guest of the booked Experience, an itinerary adjustment by itself does not create a right to a refund.
10. Refund Protect
Refund Protect may be offered as an optional service during the booking process. Where purchased, Refund Protect is provided subject to the separate terms, eligibility requirements and claims process of the external Refund Protect provider. Refund Protect does not change Good Mood’s standard cancellation terms. A claim under Refund Protect must be made under the provider’s applicable terms.
11. Third-party upgrades
Certain optional services may involve external providers. If a guest cancels, the standard Good Mood cancellation schedule applies to the booking unless separate terms for a third-party service were clearly disclosed before purchase. Where Good Mood is unable to provide a paid optional upgrade and no suitable alternative is accepted, the amount paid for that unavailable upgrade will be refunded.
12. Refund processing
Where a refund is due under this Policy, Good Mood will arrange the refund as soon as reasonably practicable. Refunds will normally be returned through the original payment route where possible. The time required for the refunded amount to appear may depend on the payment provider or financial institution.
13. Mandatory consumer rights
This Policy provides contractual cancellation rights for Good Mood bookings. Nothing in this Policy excludes any mandatory consumer right that cannot lawfully be excluded. Good Mood Experiences are leisure services booked for a specific date or period. Where Curaçao law applies, the ordinary statutory cooling-off rules for distance contracts may not apply to such dated leisure services.
